Terms & Conditions

  1. The prices quoted are expressly conditioned upon the terms and conditions in this document. The terms hereinafter stated supersede other terms, understandings, and customs inconsistent with this document.
      1. Prices quoted will be effective for thirty (30) days from the date of the quotation. If Prestec Sales, Inc.™ (PSI) receives Purchaser’s acceptance after the expiration date, the quoted prices, and such acceptance, shall only be binding upon PSI by PSI’s written confirmation of such prices.
      2. PSI guarantees that the equipment it supplies will be free from defective material and/or workmanship starting on the date the equipment is accepted by the purchaser and ends ninety (90) days thereafter. Any defects must be reported to PSI immediately in writing. Defective parts under the above warranty will be replaced F.O.B. Gainesville, Georgia or point of shipment.
      3. PSI shall not be liable for any incidental or consequential damages; PSI’s total warranty liability is limited to the repair or replacement of the goods at PSI’s discretion. PSI shall not be responsible for costs more than the purchase price. This warranty shall only apply to goods located/used in the Continental United States.
      4. PSI shall not be held liable for any defects or damage due to negligence (other than that of the seller), accident, abuse, improper installation (other than that by PSI), improper operation or maintenance, or abnormal conditions.
      5. PSI shall not be held liable for any claims for labor or installation costs to install or replace any defective parts or equipment. PSI shall not be held liable for any losses, damages, or delays resulting from defective parts or equipment.
      6. Equipment not manufactured by PSI supplied as a component is not covered by this warranty, however, PSI will pass on to our purchaser the benefit of any adjustment for the manufacturer’s warranty of the defective component.
      7. Prices for undelivered portions of continuing installment orders are subject to change whenever PSI’s costs are affected by Federal or State Legislation, changes in costs of raw materials and/or labor rates, together with applicable overhead for such costs.
  2. PSI guarantees to the original purchaser that the equipment supplied will perform at its rated capacity when the equipment is properly installed and maintained and is operated under conditions as specified in the quotation, order acknowledgement and/or invoice. Any change in operating conditions or specifications after the shipment of equipment shall immediately relieve PSI of this guarantee.
  3. PSI shall not be responsible for errors, or defects in the work, on account of plans, designs, specifications, or drawings furnished by the Purchaser. PSI’s quotation is based upon reliance on the accuracy of the data supplied by the Purchaser.
  4. Delivery schedules are approximate, and PSI will use its best efforts to meet quoted delivery schedules. However, PSI shall not be held liable for any losses or damages resulting from delays in shipment. Delays in shipment shall not be the cause for cancellation of any order.
  5. Buyer may not cancel orders placed with PSI except by written consent of PSI and payment of applicable cancellation charges. Changes in specifications or operating conditions prior to shipment of order will be permitted providing the buyer agrees to compensate PSI for any losses as the result of these changes.
  6. PSI shall not be considered in default in the performance of its obligations hereunder if such performance of its obligations is prevented or delayed by an Act of God, Outbreak of Hostilities, War, Revolution, Civil Commotion, Riot, Epidemic, Wind, Flood, Earthquake, any Law Order, Proclamation, Regulation, or Ordinance of any Government or subdivision of Government, delay in delivery of materials, delay of subcontractors, or any other cause, whether similar or different from those listed, which are beyond the reasonable control of the party affected.
  7. All goods shall be subject to normal manufacturing variations of Seller and its raw materials supplies.
  8. PSI will not accept the return of any parts or equipment without its written consent. All authorized returns shall be F.O.B. Gainesville, Georgia or point of shipment and shall be subject to applicable restocking charges.
  9. PSI will not recognize claims or make allowances for replacement of materials or correction of PSI’s error unless is given notice in writing of such defect at least 10 days prior to the Purchaser incurring any cost of expense on account thereof.
  10. Terms of the sales are Net 30 days.
  11. PSI accepts checks and ACH/EFT for payment. PSI accepts credit card payments but there is a minimum 4.5% processing fee on the dollar amount of each invoice.
  12. PSI reserves the right to correct any clerical errors on quotations, order acknowledgements or invoices.
  13. The warranties, guarantees and/or other conditions as herein set forth shall not be enlarged, modified, or changed in any way by the terms of the Buyer’s purchase orders.
  14. The warranties, guarantees and/or other conditions herein set forth are expressly in lieu of all other warranties, guarantees and/or conditions expressed or implied.
  15. The pricing is for equipment only. No freight, handling, duty, insurance, or other fees included unless otherwise stated in the quotation.
  16. Shipment of goods will be sent collect unless otherwise stated on customer’s purchase order. If the purchase order does not state logistics instructions, PSI will choose carrier.
